This Notice of Privacy Practices (“Notice”) explains the types of personal health information we collect, how we may use or disclose it, and the rights you have regarding your information. This Notice follows the HIPAA Omnibus Rule and applies to all PHI as defined by federal law.
Understanding Your Health Record
Each time you visit MaxCare Clinic, we create a record that may include your symptoms, diagnoses, test results, treatment plans, and progress notes. This record helps us:
- Plan and coordinate your care.
- Communicate with other healthcare professionals involved in your treatment.
- Document the services provided for legal and billing purposes.
- Process payment from you, your insurance, or other payers.
- Review and improve the quality of care we provide.
- Comply with legal and regulatory requirements.
Your Rights Regarding Your PHI
While your medical record is the physical property of MaxCare Clinic, the information belongs to you. You have the right to:
- Access, inspect, and obtain a copy of your medical record, including an electronic copy if available.
- Request amendments if you believe your information is incorrect or incomplete (with certain exceptions).
- Request a list of disclosures of your PHI, except for disclosures related to treatment, payment, healthcare operations, and other permitted uses.
- Request restrictions on certain uses or disclosures. We are not always required to agree but will comply when legally required (e.g., self-paid services not shared with insurance).
- Request alternative communications (e.g., via email or to a different mailing address).
- Revoke your authorization to use or disclose PHI, except where action has already been taken.
Our Responsibilities
MaxCare Clinic is legally required to:
- Maintain the privacy of your PHI.
- Provide this Notice and abide by its terms.
- Notify you in writing if a breach of unsecured PHI occurs.
- Follow HIPAA regulations and other applicable laws.
We reserve the right to update this Notice and apply changes to all PHI we maintain. Updated Notices will be made available to you.
How We May Use and Disclose Your PHI
We may use or share your PHI without your written authorization in certain situations, including but not limited to:
- Treatment: Sharing information with other providers to coordinate your care.
- Payment: Using PHI to bill and receive payment from insurance or other payers.
- Healthcare Operations: Quality assessment, training, and administrative purposes.
- Public Health & Safety: Reporting certain diseases, injuries, or public health threats.
- Law Enforcement & Legal Requirements: Complying with court orders, subpoenas, or legal processes.
- Organ Donation & Coroners: Assisting with organ procurement or investigations into a death.
- Workers’ Compensation: Complying with related laws.
- Research: When approved by an institutional review board or permitted by law.
Any uses or disclosures not described in this Notice will require your written authorization.
